First Offense (BAC less than .15%)

Confinement in jail for up to six months, fine of $100 to $500, license revocation for six months or for a period of time conditioned on participation in the test and lock program (typically between 125 days and 180 days)

Aggravated DUI (BAC .15% or higher) 

Confinement in jail for not less than two days and up to six months, with actual confinement of not less than 24 hours, fine of $200 to $1,000, license revocation for one year or for a period of time conditioned on participation in the test and lock program (typically 315 days)

DUI Causing Bodily Injury 

Confinement in jail for not less than one day and up to six months, fine of $200 to $1,000, license revocation for two years or for a period of time conditioned on participation in the test and lock program

DUI Causing Serious Bodily Injury 

Imprisonment in state correctional facility for not less than two nor more than 10 years, fine of $1,000 to $3,000, license revocation for five years or for a period of time conditioned on participation in the test and lock program

DUI Causing Death 

Imprisonment in state correctional facility for not less than three nor more than 15 years, fine of $1,000 to $3,000, license revocation for 10 years or for a period of time conditioned on participation in the test and lock program

Permitting a DUI 

Confinement in jail for up to six months, fine of $100 to $500, license revocation for six months

DUI Under 21 

Fine of $25 to $100, license suspended for 60 days or for a period of time conditioned on participation in the test and lock program

Second Offense DUI 

Confinement for six months to one year, fine of $1,000 to $3,000, license revocation for 10 years or for a period of time conditioned on participation in the test and lock program (typically 3 years)

Third Offense DUI 

Imprisonment in state correctional facility for not less than two nor more than five years, fine of $3,000 to $5,000, license revocation for life or for a period of time conditioned on participation in the test and lock program
